As part of our contract with the three major Credit Bureaus and we set out these requirements that our clients must be in compliance.
The following terms and conditions govern the use by you of the Premium Credit Bureau website located at www.premiumcreditbureau.com (the Website"). The terms and conditions set forth herein apply to all materials, online communications and other information and materials that are or become available on this Website (collectively, the "Information"). Please read these terms and conditions carefully before accessing this Website. BY SIGNING ON AND USING THIS WEBSITE, YOU SPECIFICALLY AGREE TO EACH OF THE PROVISIONS OF THE FOLLOWING AGREEMENT.
UNDER NO CIRCUMSTANCES WILL PREMIUM BE LIABLE FOR ANY DIRECT, INDIRECT, INCIDENTAL, SPECIAL, PUNITIVE OR CONSEQUENTIAL DAMAGES THAT MAY RESULT FROM THE USE OR INABILITY TO USE THIS WEBSITE OR THE INFORMATION, INCLUDING WITHOUT LIMITATION, LOST REVENUES, LOST PROFITS, LOSS OF PROSPECTIVE ECONOMIC ADVANTANGE, USE OF OR RELIANCE ON THE INFORMATION, INTERRUPTIONS, ERRORS, DEFECTS, MISTAKES, OMISSIONS, DELETION OF FILES, DISABLING DEVICES, DELAYS IN OPERATION OR TRANSMISSION, NON-DELIVERY OF INFORMATION, DISCLOSURE OF COMMUNICATIONS, OR ANY OTHER FAILURE OF PERFORMANCE RESULTING FROM THE USE OR MISUSE OF THE PREMIUM WEBSITE, OR THE INFORMATION HEREIN.
This Agreement will be governed by and construed in accordance with the laws of the State of Florida, without giving effect to any principles of conflicts of law. If any provision of this Agreement shall be unlawful, void or for any reason unenforceable, then that provision shall be deemed severable from this Agreement and will not affect the validity and enforceability of any remaining provisions. This Agreement constitutes the entire agreement of the parties with respect to the subject matter hereof, and supersedes all previous written or oral agreements between the parties with respect to such subject matter.
You, the customer, agree that any information obtained through Premium
Credit Bureau will only be used for:
1) permitted purposes under the Fair Credit ACT.
2) purposes that are relevant to the subject matter of a documented civil or criminal action.
You agree to indemnify Premium Credit Bureau, its suppliers, employees and officers for any and all damages, claims, or losses suffered by Premium as a result of possible claims by third parties relating to use of the data provided by Premium.
Premium shall be indemnified from any and all claims and consequences arising out of found or not found information.
You attest that you have not misrepresented yourself, your company, organization or your purpose for viewing the Premium Website or for ordering searches from e-factual.com. You understand that misrepresentation may result in civil and criminal action against you and your organization, employees and affiliates. You are notified that Premium information is developed using standard investigative methods including public records, third-party sources, and creditors networks. All searches are on a best effort basis, no guaranties, promises or claims are made about potential search results. Premium shall not be liable for any special, incidental or consequential damages of any type. Premium reserves the right to amend, change, or discontinue its prices and/or searches at any time. We reserve the right to refuse any client or any specific requests at any time and cooperate with law enforcement officials when misuse of information is suspected.
You assume all related legal liability, and by ordering from Premium, you consent to waive all claims against Premium resulting from searches. You agree to hold Premium, its officers, employees, and vendors harmless and to indemnify e-factual.com from any and all claims that may results from your request. You warrant that requested searches are legal and proper in your jurisdiction and comply with all applicable laws (local and state). You bear full legal costs in the event of suit and further will hold all information confidential.
Information obtained through Premium is to be used in the course of applicable FCRA approved purposes, and held strictly confidential. You warrant that the searches you request are fully legal in you and your subject's jurisdiction. You realize that most orders are processed immediately upon receipt and are non-cancelable after order receipt. You agree that visitation to the Premium Website or the placing of a search request is not for the purposes of entrapment, sting operation, or pursuit of Premium, its employees, vendors, clients, affiliates or officers.
You are billed for search requests only -- not for the results of the requested search. All searches are performed on a best-effort basis only. No refunds, exchanges, or credit. You are solely responsible for accurately filling out your order form and selecting the appropriate searches. Premium cannot be held responsible for typographical errors or mistakes in the ordering information entered by the customer. Because all orders are processed immediately, no cancellations are accepted once an order has been submitted. Search discrepancies must be reported within ten (10) days. All unpaid fees are subject to twenty percent (20%) interest from date of invoice, and you consent to suit in the jurisdiction of Premium's choice. You consent to all terms & conditions as amended by Premium from time to time.
